2.1. Description of the Service

CookiesWork is a cookie consent management platform (Consent Management Platform - CMP) provided as Software as a Service (SaaS). It allows website publishers to collect, record, and document the consent of their users in compliance with the GDPR (General Data Protection Regulation) and CNIL directives.

2.2. Access to the Service & Account Creation

The use of CookiesWork requires the creation of a professional account. You agree to provide accurate and complete information and to maintain the security of your login credentials. Access to certain advanced features depends on the subscribed formula (Free, Starter, Pro, Enterprise).

2.3. Billing and Subscriptions

Subscriptions are billed monthly on the subscription anniversary date. Unless terminated by the user before the automatic renewal date via the dashboard, the subscription is tacitly renewed for the same duration. In the event of exceeding the monthly consent or allocated website quotas, CookiesWork reserves the right to temporarily suspend the service or propose a plan upgrade.

2.4. User Obligations

The user agrees to integrate the embed.js script on their site in accordance with technical instructions. As the Data Controller for their own end-users, it is their responsibility to correctly configure the categories of trackers (essential, analytical, marketing) to reflect the technical reality of their site.

2.5. Limitation of Liability

CookiesWork implements all reasonable means to guarantee the availability of its platform and its integration scripts (SLA of 99.9%). However, CookiesWork cannot be held liable in case of non-compliance with the legislation by the user (notably in case of incorrect configuration on their part leading to the placement of trackers before obtaining consent). The maximum cumulative liability of CookiesWork in the event of proven direct damage is strictly limited to the annual amount paid by the user for their subscription.

2.6. Intellectual Property

The general structure of the website, source code, integration scripts (embed.js), designs, and trademarks are the exclusive property of CookiesWork. Any unauthorized reproduction, modification, or commercial exploitation is strictly prohibited.

These terms of use are governed by French law. In the event of any dispute regarding the interpretation, execution, or termination of the contract, and after an unsuccessful attempt at amicable resolution, express jurisdiction is granted to the Commercial Court of Paris, notwithstanding multiple defendants or third-party appeals.
